Legislation Enacted in 2018House Bill 1608 renames a Huntingdon County bridge. Act 1 of 2018 House Bill 1175 amends state law relating to lobbying disclosure to provide for an electronic registration filing system and to increase fines and penalties for violations of the act. Act 2 of 2018 House Bill 359 addresses penalties for hunters who mistakenly kill an animal. Act 3 of 2018 House Bill 1602 renames several bridges. Act 4 of 2018 House Bill 1653 makes students enrolled in distance, or online, education programs eligible for state grants. Act 5 of 2018 Senate Bill 354 strengthens licensee reporting requirements to the Department of State. Act 6 of 2018 Senate Bill 497 eliminates the “waste” designation for steel slag when it is sold as a commodity and is not a discarded material. Act 7 of 2018 Senate Bill 542 permits pharmacists to dispense emergency prescription refills for up to 30 days pursuant to certain restrictions. Act 8 of 2018 Senate Bill 894 renames roads and bridges. Act 9 of 2018 House Bill 631 requires those convicted of a Tier 3 sexual offense be sentenced to a mandatory period of probation of three years consecutive to and in addition to any other sentence issued by the court and addresses a state Pennsylvania Supreme Court decision that impacts Pennsylvania’s sexual offender registration act. Act 10 of 2018 Senate Bill 135 would permit the use of a leashed tracking dog to track white-tailed deer to recover an animal which has been legally harvested or wounded. Act 11 of 2018 House Bill 1845 designates an Indiana County bridge as the First Lieutenant Theodore P. Pytash Bridge. Act 12 of 2018 House Bill 1854 designates a portion of Route 522 in Snyder County as the Staff Sgt. Stanley R. Saylor Memorial Highway. Act 13 of 2018 Senate Bill 449 would allow Magisterial District Judges to use a risk assessment tool when determining bail in domestic violence cases. Act 14 of 2018 House Bill 1486 exempts “high tunnels” from the requirements of the Storm Water Management Act. Act 15 of 2018 House Bill 1341 amends the Bituminous Coal Mine Safety Act to allow emergency medical responders to be employed at mines. Act 16 of 2018 House Bill 595 specifically provides for the types of complaints that can be filed with the Bureau of Consumer Protection regarding planned communities, cooperatives and condominiums. Act 17 of 2018 House Bill 866 amends the Local Tax Enabling Act to clarify certain provisions related to the consolidated collection of local income taxes and delinquent taxes. Baker, Brooks, Killion, Laughlin, McGarrigle, Rafferty Scavello, Tomlinson all no Act 18 of 2018 House Bill 1926 designates a portion of Fort Washington Avenue in Montgomery County as the SPC5 George W. Charters, Jr., Memorial Highway. Act 19 of 2018 Senate Bill 837 is a highway renaming bill. Act 20 of 2018 Senate Bill 844 expands the legal standing for individuals seeking to gain custody of children where both biological parents are absent, whether due to death or for other reasons. Act 21 of 2018 Senate Bill 877 amends the Insurance Department Act to allow producers and insurers to spend as much as $100 in marketing insurance to a client or prospective client. Act 22 of 2018 Senate Bill 878 amends the Insurance Company Law to allow producers and insurers to spend as much as $100 in marketing insurance to a client or prospective client. Act 23 of 2018 House Bill 1869 establishes a committee to review maternal deaths and develop strategies for the prevention of maternal deaths. Act 24 of 2018 House Bill 478 requires outpatient psychiatric clinics to have a psychiatrist on site for two hours of psychiatric time per week for each full-time equivalent treatment staff member employed by the clinic. Act 25 of 2018 Senate Bill 630 reforms insurance licensure requirements for travel agents. Act 26 of 2018 House Bill 566 provides for the suspension of services by a contractor or a subcontractor if timely payment is not received in accordance with the terms of a construction contract. Act 27 of 2018 House Bill 1793 creates the Pennsylvania Commission for the United States Semiquincentennial. Act 28 of 2018 House Bill 1952 addresses a state Pennsylvania Supreme Court decision that impacts Pennsylvania’s sexual offender registration act. Act 29 of 2018 Senate Bill 234 establishes the Property Assessed Clean Energy program. Act 30 of 2018 Senate Bill 880 allows trailers up to 102-inches wide on Pennsylvania highways. Act 31 of 2018 House Bill 653 provides for an accelerated foreclosure process for vacant and abandoned property. Act 32 of 2018 Senate Bill 667 gives redevelopment authorities the same powers currently allotted to land banks through the Pennsylvania Land Bank Act. Act 33 of 2018 House Bill 352 reduces the period of time needed to acquire a title through adverse possession under specified circumstances. Act 34 of 2018 House Bill 564 requires students to pass a test that is identical to the civics test produced by the United States Citizenship and Immigration Services as a condition of high school graduation. Act 35 of 2018 House Bill 1641 creates the Employment First Act. Act 36 of 2018 Senate Bill 776 extends the Dyslexia and Early Literacy Intervention Pilot Program. Act 37 of 2018 Senate Bill 851 amends the Real Estate Tax Sale Law to clarify ownership of properties that are in the delinquent tax sale process. Act 38 of 2018 House Bill 1448 is the Education Code component of the Fiscal Year 2018-19 budget. Act 39 of 2018 House Bill 1677 is the Human Services Code component of the Fiscal Year 2018-19 budget. Act 40 of 2018 House Bill 1851 requires the Insurance Department to formalize its exam process with best practices. Act 41 of 2018 House Bill 1929 is the Fiscal Code component of the Fiscal Year 2018-19 budget. Act 42 of 2018 House Bill 2477 clarifies the clinical research component of the Medical Marijuana Act. The bill returns to the House for concurrence on Senate amendments. Act 43 of 2018 Senate Bill 1142 establishes the Safe2Say Program and provides methods of anonymous reporting of unsafe activities in schools and other measures to improve school safety. Act 44 of 2018 House Bill 2468 requires any government agency to obtain Orphans’ Court approval before using eminent domain to take permanently preserved land. The bill returns to the House for concurrence on Senate amendments. Act 45 of 2018 House Bill 1979 removes a sunset provision for a 20-year statute of limitations on actions on instruments under seal. Act 46 of 2018 House Bill 17 amends the Drug and Alcohol Abuse Control Act to specify that a parent or guardian is authorized to provide consent for treatment of their minor child. Act 47 of 2018 House Bill 152 requires the Insurance Department to administer and maintain a database of life insurance policies to search for potential beneficiaries. Act 48 of 2018 House Bill 159 clarifies that the failure of a child to comply with a lawful sentence imposed for a summary offense constitutes a “delinquent act” and that further provides that juvenile courts will retain jurisdiction over enforcement of such cases. Act 49 of 2018 House Bill 594 prohibits Accelerated Rehabilitation Disposition for certain offenses against children. Act 50 of 2018 House Bill 824 establishes the National Guard Youth Challenge Program. The bill returns to the House for concurrence on Senate amendments. Act 51 of 2018 House Bill 994 clarifies that the sales of telephones, telephone numbers, modems, tablets and related accessories, including cases, chargers, holsters, clips, hands free devices, screen protectors and batteries are not subject to the gross receipts tax. Act 52 of 2018 House Bill 1124 provides for the offense of neglect of a care-dependent person and creates the offense of abuse of a care-dependent person. Act 53 of 2018 House Bill 1232 requires schools and hospitals to display a poster that includes the statewide toll-free telephone number for reporting suspected child abuse or neglect. It also reforms expungement guidelines for the Statewide Database of Protective Services within the Department of Human Services and County Child Protective Services Databases. Act 54 of 2018 House Bill 1644 establishes the Collaborative Law Act. Act 55 of 2018 House Bill 1419 provides those with low-level, nonviolent criminal records a mechanism to have their record sealed from public view. Act 56 of 2018 House Bill 1738 allows trained and certified non-municipal police officers the same jurisdictional flexibility as municipal police officers. Act 57 of 2018 House Bill 1782 authorizes the use of alternative rate mechanisms by public utilities. Act 58 of 2018 House Bill 1898 requires dealer disclosure of vehicles with unaddressed recalls at time of sale. Act 59 of 2018 House Bill 1918 updates and upgrades state law to help prevent, eliminate and punish the use of fraudulent credit card devices. Act 60 of 2018 House Bill 2067 renames several roads and bridges. Act 61 of 2018 Senate Bill 431 increases fines for littering. Act 62 of 2018 Senate Bill 499 would allow the Board of Prison Inspectors in Eighth Class counties to meet less frequently. Act 63 of 2018 Senate Bill 552 redirects funds from the Veterans Trust Fund that came from the Pennsylvania Monuments License Registration Plate to the new Pennsylvania Veterans’ Monuments and Memorial Trust Fund and would require those funds be used for the operation and maintenance of monuments designated by Department of Military & Veterans Affairs in consultation with the State Veterans’ Commission. Act 64 of 2018 Senate Bill 564 requires PENNDOT to include protective fencing in the construction of new bridges and major renovations of existing bridges over interstate highways. Act 65 of 2018 Senate Bill 817 addresses property issues involving the Department of General Services. Act 66 of 2018 Senate Bill 892 amends the Chiropractic Practice Act to provide clarity on the topic of clinical training. Act 67 of 2018 Senate Bill 934 expands the authority of the Elevator Advisory Board, a subcommittee of the Industrial Board under the Pennsylvania Department of Labor & Industry. Act 68 of 2018 Senate Bill 978 addresses drug disposal after hospice care. Act 69 of 2018 Senate Bill 1002 renames bridges and highways. Act 70 of 2018 Senate Bill 1037 reforms and modernizes the Pennsylvania Civil Service Commission. Act 71 of 2018 Senate Bill 1056 allows long-standing deductions for depreciation in determining taxable income. Act 72 of 2018 Senate Bill 1091 provides for contributions for pediatric cancer research and establishes the Pediatric Cancer Research Fund. Act 73 of 2018 Senate Bill 1101 reduces the need for some consumers to obtain a recovered theft vehicle title by creating a damage threshold that would trigger this requirement. Act 74 of 2018 House Bill 863 amends the Real Estate Licensing and Registration Act to increase the educational requirements for the salesperson license and to authorize brokers and salespersons to prepare Broker Price Opinions. Act 75 of 2018 Senate Bill 530 updates Act 136 of 1998, the Social Workers, Marriage and Family Therapists and Professional Counselors Act. Act 76 of 2018 House Bill 1917 provides for additional qualifications for the appointment, training, oversight and continuing education for humane society police officers. Act 77 of 2018 House Bill 1346 provides for the offense of unlawful use of an unmanned aircraft and the preemption of local ordinances or regulations. Act 78 of 2018 House Bill 2060 provides for the relinquishment of firearms following a conviction of a misdemeanor offense for domestic violence or the court issuance of a protection from abuse order. Act 79 of 2018 Senate Bill 1090 increases penalties for hazing and requires schools to have policies and reporting procedures in place to stop hazing. Act 80 of 2018 House Bill 783 exempts manufactured homes not previously titled in Pennsylvania from the tax certification requirement. Act 81 of 2018 House Bill 1386 amends the Public School Code by adding a new section concerning instructional certificate grade spans and age levels. Act 82 of 2018 House Bill 1414 authorizes visual and audible signals on emergency vehicles for additional fire personnel; flashing yellow and white lights on tow trucks; yellow strobe lights for solid waste collection vehicles; and mounted internal blue lights for volunteer firefighters. Act 83 of 2018 House Bill 1499 amends Title 68 (Real and Personal Property) to clarify and update provisions relating to planned communities, condominiums and cooperatives. Act 84 of 2018 House Bill 2297 renames several roads and bridges. Act 85 of 2018 Senate Bill 172 provides a three-year trial period for PENNDOT to place speed cameras in active work zones on limited access highways. Act 86 of 2018 House Bill 270 increases the PACENET income eligibility limits from $23,500 to $27,500 for individuals and from $31,500 to $35,500 for married couples. Act 87 of 2018 House Bill 1539 allows a grandparent or other specific relatives of a minor child to petition for temporary guardianship when a parent of that child has entered a rehabilitation facility for treatment of a drug or alcohol addiction or has been subject to emergency medical intervention due to abuse of drugs or alcohol. Act 88 of 2018 House Bill 2133 creates the Kinship Caregiver Navigator Program. Act 89 of 2018 Senate Bill 180 updates and revises state law relating to organ and tissue donations. Act 90 of 2018 House Bill 26 permits organizational registration plates for use on motorcycles; and allows for abbreviated portions of an organization’s name on special plates. Act 91 of 2018 House Bill 44 amends the Protection from Abuse Act to provide the court with information regarding whether the defendant has been involved with a child abuse investigation. Act 92 of 2018 House Bill 126 allows certain entities to have non-patient specific epinephrine auto-injectors. Act 93 of 2018 House Bill 149 addresses the unlawful use of an audio or video recording device in court. Act 94 of 2018 House Bill 163 removes language relating to federally mandated driver’s license suspensions for drug/controlled substance convictions, as well as state-imposed suspensions for six other crimes. Act 95 of 2018 House Bill 353 requires electronic prescriptions for certain controlled substances. Act 96 of 2018 House Bill 504 allows owners of self-service storage units to obtain a limited license from the Pennsylvania Insurance Department to sell insurance to those renting storage space to cover the contents of the storage units. Act 97 of 2018 House Bill 544 addresses the issue of recreational use and liability to protect landowners in the event of injuries to recreational users. Act 98 of 2018 House Bill 99 allows boroughs to enter contracts or make purchases without advertising, bidding or price quotations in emergency situations. Act 99 of 2018 House Bill 645 amends Article XIX-A (Neighborhood Assistance Tax Credit) of the Tax Reform Code of 1971 further providing for tax credit and grant of tax credit and providing for reporting. Act 100 of 2018 House Bill 927 provides for a municipal exemption from leaf waste collection requirements. Act 101 of 2018 House Bill 983 ensures that an abusive spouse is ineligible to receive financial support from the person that he or she was convicted of abusing. Act 102 of 2018 House Bill 1013 requires managed care plans and Medicaid to pay all reasonably necessary costs associated with the provision of emergency services even if the covered individual does not require transport or refuses to be transported. Act 103 of 2018 House Bill 1216 provides that any law enforcement officer, humane society police officer, animal control officer or emergency responder who enters an unattended vehicle in order to rescue a dog or cat will not be liable for any damage caused by the rescue. Act 104 of 2018 House Bill 1228 permits students to self-apply a topical sunscreen during school or at school activities without a physician’s note or prescription. Act 105 of 2018 House Bill 1233 establishes a new standard for assisted outpatient treatment for seriously mentally ill individuals. Act 106 of 2018 House Bill 1284 enacts the Pennsylvania Business One-Stop Shop Act to provide online, one-stop services to assist businesses. Act 107 of 2018 House Bill 1294 allows motorcycles to be equipped with a special registration plate for Purple Heart and Legion of Merit recipients. Act 108 of 2018 House Bill 1511 amends the Tax Reform Code providing for definitions and imposition of tax in hotel occupancy tax and establishing a restricted revenue account to be known as the Tourism Promotion Fund. Act 109 of 2018 House Bill 1822 establishes a new chapter in Title 24 (Education) concerning suicide prevention in institutions of higher education. Act 110 of 2018 House Bill 1840 re-establishes a provision in the Workers’ Compensation Act authorizing Impairment Rating Evaluations for claimants, addresses the Supreme Court’s Protz ruling (Protz vs Derry Area School District), and increases the burial benefit in the Workers’ Compensation Act from $3,000 to $7,000. Act 111 of 2018 House Bill 1884 creates the Patient Test Result Information Act. Act 112 of 2018 House Bill 1885 allows a Register of Wills to determine and direct the personal representative of an estate to post additional security after examining the inventory or inheritance tax return of an estate. The bill returns to the House for concurrence on Senate amendments. Act 113 of 2018 House Bill 1886 updates Orphans’ Court report procedures. Act 114 of 2018 House Bill 1936 makes editorial and technical changes to the Snowmobile and All-Terrain Vehicle Law. Act 115 of 2018 House Bill 1951 provides a new offense for selling dextromethorphan to minors. Act 116 of 2018 House Bill 1958 authorizes the use of highly automated work zone vehicles by PENNDOT and the Turnpike Commission and allows for the platooning of motor carrier vehicles. Act 117 of 2018 House Bill 2049 creates the Assistance and Service Animal Integrity Act to address documentation requirements for service animals in housing, and establishes penalties for misrepresentation. Act 118 of 2018 House Bill 2052 amends the Public School Code by adding a new section concerning military parent student support. Act 119 of 2018 House Bill 2075 authorizes rate recovery by a water public utility for costs incurred to replace customer-owned lead water service lines. The bill returns to the House for concurrence on Senate amendments. Act 120 of 2018 House Bill 2124 requires institutions of higher education to send annual letters to students with information on their student loan debt, including estimates of their total debt at graduation and estimated monthly payments. Act 121 of 2018 House Bill 2453 amends the Check Casher Licensing Act to strengthen enforcement provisions, increase penalties and permit cashing of certain postdated checks. Act 122 of 2018 House Bill 2476 allows Commonwealth employees to carry or store a lawfully owned firearm and ammunition in a vehicle at a state correctional institution. Act 123 of 2018 House Bill 2557 extends Harrisburg’s expanded taxing capabilities after its exit from Act 47. Act 124 of 2018 Senate Bill 6 is designed to eradicate waste, fraud, and abuse within the Commonwealth’s Public Welfare Code. Act 125 of 2018 Senate Bill 31 invests $1 million in a program that awards grants for research into spinal cord injuries. Act 126 of 2018 Senate Bill 299 changes the way that an incumbent magisterial district judge gets on the ballot for re-election. Act 127 of 2018 Senate Bill 353 a land conveyance bill. Act 128 of 2018 Senate Bill 403 removes the Governor’s appointment of an FBI Agent to the Municipal Police Officers Education & Training Commission and replaces it with a Governor’s appointment of a member of the State Fraternal Order of Police. Act 130 of 2018 Senate Bill 627 ensures that all air freight companies are treated equally under Pennsylvania tax law. Act 131 of 2018 Senate Bill 676 addresses ongoing funding deficiencies in the Workers’ Compensation Uninsured Employers Guarantee Fund. Act 132 of 2018 Senate Bill 748 establishes notice guidelines regarding the proposed closure of state prisons. Act 133 of 2018 Senate Bill 764 creates a recreational vehicle (RV) specific law which would govern RV dealers, manufacturers, and salespeople. Act 134 of 2018 Senate Bill 771 amends the Borough Code and Third Class City Code to provide for concise publication of required annual financial reporting information, thus saving boroughs and cities, and their taxpayers, money. Act 137 of 2018 Senate Bill 796 exempts CDL licensees from change of address fees if they have not actually moved from their home and the change of address is due to a governmental action beyond their control. Act 139 of 2018 Senate Bill 801 allows boroughs and Third-Class Cities to purchase used equipment, vehicles and other personal property from volunteer emergency service organizations without competitive bidding. Act 143 of 2018 Senate Bill 888 would improve access to disabled parking spaces by prohibiting the obstruction of access aisles and strengthening enforcement measures. Act 144 of 2018 Senate Bill 897 expands the scope of restitution for victims to include government agencies, non-profits, corporations and other similar organizations. Act 157 of 2018 Senate Bill 1095 provides alternatives to Keystone Exams. Act 158 of 2018 Senate Bill 1098 would allow for the placement of cameras on school buses to capture motorists who pass when red signals are flashing. Act 159 of 2018 Senate Bill 1127 creates a new penalty for the fraudulent trafficking of SNAP benefits in an amount greater than $2,500. Violators would be required to pay restitution of up to three times the amount of fraud they committed. Act 160 of 2018 Senate Bill 1156 renames roads and bridges. Act 15A of 2018 Legislation Vetoed by the Governor in 2018Senate Bill 936 requires the Pennsylvania Department of Labor & Industry to adopt an evidence-based drug formulary for Pennsylvania’s Workers’ Compensation program. Veto 1 of 2018 House Bill 2138 adds work requirements for eligible enrollees in Medical Assistance. Veto 2 of 2018 House Bill 83 requires that, except in cases of refunding bond issuance, all debt amortization must be done using an equal annual maturities plan. Veto 3 of 2018 House Bill 2157 amends the Public School Code concerning the Commission for Agricultural Education Excellence, the utilization of credits, and the classification of program codes. Veto 4 of 2018 Senate Bill 1172 amends the Price Gouging Act. Veto 5 of 2018 |
